1. Introduction
PadiDoctors is a digital health platform that provides symptom triage, AI-assisted clinical decision support, telemedicine consultations, and related health services to users in Nigeria and West Africa. These Terms of Use (“Terms”) form a binding agreement between you and PadiDoctors.
These Terms are to be read together with our Privacy Policy and, where applicable, the Clinician Terms of Engagement for doctors.
2. Eligibility
You must be at least 18 years old or have parental/guardian consent to use PadiDoctors. By using the Platform, you represent that you have the legal capacity to enter into this agreement under Nigerian law.
3. Nature of Services
PadiDoctors provides symptom triage, health information, and access to licensed clinicians via digital channels. The Platform is not an emergency service and does not replace physical emergency care.
4. User Responsibilities
You agree to provide accurate information, use the Platform lawfully, respect clinicians and staff, and follow any additional instructions displayed on the Platform.
5. Clinician Obligations
If you use the Platform as a clinician, you must also comply with the Clinician Terms of Engagement and the rules of your professional regulatory body. PadiDoctors itself does not practice medicine.
6. AI-Assisted Tools & Limitations
PadiDoctors may use AI-assisted tools for triage and decision support. These tools do not replace human clinical judgment, and all final decisions rest with licensed clinicians.
7. Accounts, Security & Access
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account.
8. Fees, Payments & Refunds
Fees for consultations and services will be shown clearly before you are charged. Payment processing and refund rules may be updated from time to time and will be communicated through the Platform.
9. Acceptable Use
You agree not to misuse the Platform, including but not limited to fraud, harassment, uploading harmful content, or attempting to interfere with the technical operation of the service.
10. Data Protection & Compliance
PadiDoctors processes personal and health data in accordance with the Nigeria Data Protection Act 2023, the NDPR, the National Health Act 2014, and other applicable regulations, as further detailed in our Privacy Policy.
11. Data Retention
We retain health records and related logs for the periods described in our Privacy Policy and in compliance with legal and regulatory requirements.
12. Intellectual Property
All content, branding, algorithms, and software used in the Platform are owned by or licensed to PadiDoctors and may not be copied or reused without written permission.
13. Suspension & Termination
We may suspend or terminate your access to the Platform if you violate these Terms, applicable law, or pose a risk to patient safety or platform integrity.
14. Disclaimers & Limitation of Liability
While we strive to ensure safe and reliable services, PadiDoctors cannot guarantee specific health outcomes or uninterrupted access. To the fullest extent permitted by law, we limit our liability for indirect or consequential damages.
15. Changes to these Terms
We may update these Terms periodically. We will indicate the “Last Updated” date and, where required, notify you of significant changes. Continued use of the Platform constitutes acceptance of the updated Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved through amicable negotiation in the first instance and may, if necessary, be escalated to arbitration or the competent courts in Nigeria.
